CANYON CREATIVE TERMS AND CONDITIONS

 

We are Canyon Creative Studio, LLC and Canyon Creative Design, LLC ("Company," "we," "our," "us") with our websites at www.canyoncreative.studio  ("Studio Site") and www.canyoncreative.design  ("Design Site") (collectively, the "Sites"). These Terms and Conditions ("Terms") apply to your use of both Sites. The Studio Site offers products for sale online and in our physical showroom. The Design Site is a portfolio and informational site only; it does not offer products for sale or accept orders. Sections of these Terms relating to purchases, returns, shipping, and order acceptance apply only to the Studio Site. All users are bound by the general terms, privacy policy, intellectual property, accessibility, and other provisions.

 

Please read these terms and conditions carefully. Your understanding and agreement to these terms are crucial. We aim to provide clear and comprehensive information to ensure your understanding of our offerings and policies. By accessing and/or using the Site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions, which also include our Privacy Policy linked in the next paragraph below.  If you do not agree to all the Terms and Conditions, then you won't be able to access the Site or avail yourself of the goods and services we offer.  So please do review and agree.

 

Please note that the tiered design services offered by the Company are described elsewhere on the applicable Site.

 

PRIVACY: We respect and are committed to protecting your privacy.  We collect certain information in order to gather your input and, for example, process orders.  We may collect personally identifiable information when you visit our Site. We also automatically receive and record information on our server logs from your browser including your IP address, cookie information and the page(s) you visited. We explain what we use, how we use it, when, why and how you can manage the information you provide and we collect all by way of our Privacy Policy, available at Privacy Policy.

 

AGE OF CONSENT: By using this Site, you represent that you are at least the age of majority in your state of residence. This site is not intended for use by individuals under the age of majority without the supervision of a parent or guardian.

PRODUCT VARIATIONS AND TYPOGRAPHICAL ERRORS:

 

WE ASPIRE TO 100% ACCURACY COLORS AND DESCRIPTIONS (Studio Site Only): This section applies only to purchases made through the Studio Site.  The Design Site does not offer products for sale or accept orders. We aspire to 100% accuracy when describing products on our Site.  However, we're not perfect and to the extent permitted by applicable law, we do not warrant that the product descriptions, colors, or other content available on the Site are accurate, complete, reliable, current, or error free.  A particular note regarding colors: Because every computer monitor displays color differently, we cannot be responsible for variations between the actual product color and how it is displayed on your screen. Descriptions of merchandise, including colors or shades, textures, and other features are provided by the manufacturer; we assume no liability whatsoever for the description, for variance, including in colors or textures, minor imperfections, and/or for a product not meeting with customer satisfaction, absent a manufacturer-verified defect.

 

TYPOGRAPHICAL ERRORS (Studio Site Only): This section applies only to purchases made through the Studio Site.  The Design Site does not offer products for sale or accept orders.  In the event that a product is listed at an incorrect price on the Site due to a typographical error, technical glitch, or incorrect price information provided by a third-party supplier, we reserve the right to refuse or cancel any orders placed for a product listed at the incorrect price. We will inform you promptly of any such error and any correction made. We are good about not letting that happen and acting quickly to remedy any errors we see but we do reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall issue a credit to your credit card account in the amount charged to your credit card.

 

ESTIMATED SHIPPING AND DELIVERY TIMES (Studio Site Only): This section applies only to purchases made through the Studio Site.  The Design Site does not offer products for sale or accept orders.  Estimated shipping times are located on each product page. Please note that these are only estimated shipping times and are subject to availability of products and/or manufacturer's availability. If a product you have ordered is out of stock or on backorder, we will contact you with a new shipment date. At that time, you can decide to either keep the order as is, cancel the item, or cancel the entire order. We will do our best to keep you updated on issues that arise due to any back up in production. If there is a problem, we will alert you as soon as we are made aware that a problem exists.

 

RETURNS (Studio Site Only): This section applies only to purchases made through the Studio Site.  The Design Site does not offer products for sale or accept orders.  We want you to be happy with your purchase! Eligible items can be returned with a complimentary return label when a return is requested within 30 days of receiving your purchase. We do not refund original shipping charges, unless the return is a result of our error. Please contact us at support@canyoncreative.studio and we will provide you with a shipping label to return your product. All items must be sent back in the original packaging. If original packaging is unavailable, the customer is responsible for arranging equivalent packaging. For all lighting and wallpaper, once it has been installed it cannot be returned. If your item is marked as FINAL SALE or MADE TO ORDER or is a special order, it is not eligible for return.  Returns for furniture and oversize items that travel via freight can be arranged by contacting support@canyoncreative.studio. Freight returns will be issued a refund less original shipping and handling charges in addition to a 25% restocking fee from the original product price. Return requests will only be accepted within 14 days of the delivery. If your delivery is refused due to size, return shipping charges and a 25% re-stocking fee will incur.

 

CREDIT CARD DISPUTES (Studio Site Only): This section applies only to purchases made through the Studio Site.  The Design Site does not offer products for sale or accept orders.  In the event of a disputed credit card charge, which is ultimately found to have been legitimate or which otherwise is found in whole or in part in favor of Canyon Creative, then you shall be responsible for all attorneys' fees and costs borne by us.  The terms of any purchase from or dispute with Canyon Creative shall be governed by California law, and any litigation arising out of such dispute shall be brought in the State of California, County of Los Angeles.

 

ORDER ACCEPTANCE (Studio Site Only): This section applies only to purchases made through the Studio Site.  The Design Site does not offer products for sale or accept orders.  The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. Canyon Creative reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required prior to the acceptance of an order. We will communicate any changes or limitations to your order as soon as possible.  Prices and availability of products on the Site are subject to change without notice. Errors will be corrected when discovered and Canyon Creative reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted). Certain orders constitute improper use of the Site. Canyon Creative reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Your account may also be restricted or terminated for any reason, at Canyon Creative's sole discretion. Items purchased pursuant to a quantity discount may be re-priced upon cancellation.

 

COPYRIGHT: Please do not copy images or content found on the Site. The entire content included on this Site, including but not limited to text, graphics, logos, button icons, and images is copyrighted as a collective work under United States and international copyright laws, and is the property of the Company. The collective work includes works that are licensed to the Company. Any use, including but not limited to the reproduction, distribution, display or transmission of the content of this Site is strictly prohibited, unless authorized in writing by the Company.

 

GENERAL: We reserve the right to refuse service to anyone for any reason at any time. By using this Site, you acknowledge and agree that these Terms and Conditions, constitute the complete and exclusive agreement between us concerning your use of the Site, and supersede and govern all prior proposals, agreements, or other communications. We reserve the right, in our sole discretion, to change these Terms and Conditions at any time by posting the changes on the Site. Any changes are effective immediately upon posting to the Site. Your continued use of the Site constitutes your agreement to all such terms and conditions.

 

NOTICE: The Company may deliver notice to you by e-mail, a general notice on the Site, or by other reliable method to the address you have provided to us.

 

LIMITATION OF LIABILITY: The Company, its officers, directors, employees, agents, licensors and suppliers, shall not be liable for any damages that result from the use of, or the inability to use, the materials on this Site or the performance of the products, even if the Company has been advised of the possibility of such damages. The laws of certain states may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you, and you may have additional rights.

 

TERMINATION OF TERMS AND CONDITIONS: These terms and conditions, or any part of them, may be terminated by the Company without notice at any time, for any reason. The provisions relating to Copyrights, Warranty Disclaimer, Limitation of Liability, Applicable Law and Indemnification, shall survive any termination.

 

APPLICABLE LAW: This Site, designed as a platform for clear and transparent communication of our product offerings, is professionally created, mindfully controlled, and diligently maintained by the Company, in the State of California. Accordingly, the laws of the State of California shall in all events govern any disputes relating to this Site, including those relating to any transaction conducted hereon, and shall likewise govern the terms, conditions, disclaimers, policies and notices contained herein, all without giving effect to any conflict of laws principles. The Company strives to ensure that this Site and its terms and conditions comply with all applicable laws. If you choose to access this Site from outside of the United States, you do so at your own risk and are responsible for compliance with all applicable laws. You may not use this Site in violation of United States export laws. By using this Site, including for the purpose of understanding or purchasing our products, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Los Angeles County, California, which shall serve as the sole and exclusive venue for any disputes. Any claim or cause of action brought by you with respect to matters related to this Site, including these terms and conditions, must be brought in a state or federal court located in the State of California and must be commenced no later than one (1) year after the claim arises. If any provision of these terms and conditions is deemed to be void, unlawful or unenforceable for any reason, all other provisions contained herein shall remain in full force and effect. These terms and conditions constitute the entire agreement as to matters relating to this Site.

 

IDEMNIFICATION: You agree to indemnify, defend, and hold the Site, the Company, subsidiaries, affiliates, partners, officers, directors, employees, interns, subcontractors, agents, licensors and suppliers harmless from any claim or demand, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of these terms and conditions or any activity related to you or any other person accessing this Site.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our Site.
